GENERAL INFORMATION: DESCRIPTION: Mixed soils assessed as Grade3 + much Rivington (sand stone) but with some elements of Houghton restored open cast. LOCATION: The land is generally located along the A635 corridor at Adwick on Dearne, Great Houghton & Bolton. CROPPING: The current and recent cropping is identified on the Schedule of Land. ENVIRONMENTAL STEWARDSHIP: The land is subject to an ELS Agro-Environmental Scheme which terminates on 30 December 2018. Current planted grass margins to hedges will be required to be maintained for the duration. Grass Margins (6m) to dykes will be required to be retained for LEAF for the duration of the tenancy Agreement. All ELS payments will be retained. NITRATE VULNERABLE ZONE: The land lies within a Nitrate Vulnerable Zone. WAYLEAVES AND EASEMENTS: The land is let subject to all wayleaves and easements whether formally mentioned in the tenancy agreement including these lettings details or not. The Landlord will reserve the right to retain their share for all easements and wayleaves on the land. RIGHTS OF WAY: There are public rights of way crossing the land at Houghton and access reserved to the Wind Farm facilities. ACCESS: Access to the land parcels is marked in brown on the attached plans. DRAINAGE RATES: None so far as aware. SERVICES: None. BASIC PAYMENT SCHEME: The land is registered with the Rural Payments Agency and the Basic Payment Scheme. The Basic Payment entitlements will be transferred to the incoming tenant to use for the duration of the Tenancy. Prospective tenants should satisfy themselves with the eligible areas when making the Basic Payment claim for the duration of the tenancy. There will be no in-going payment for the Basic Payment Entitlements. The incoming tenant will be obliged to transfer the entitlements back to the Landlord or his nominee at the termination of the Farm Business Tenancy Agreement, for which no payment will be made. OTHER RIGHTS: All sporting, timber and mineral rights will be retained by the Landlord and existing shooting rights at Adwick are actively enjoyed. MAIN TERMS OF AGREEMENT: TENANCY: The land is available to let on a Farm Business Tenancy for a term of 3 years. A draft FBT agreement will be available for review. EARLY ENTRY: The incoming tenant may be granted early entry onto the land by negotiation and subject to the clearance of the 2018 season crops. HOLDOVER: There will be reservation of access and storage for harvesting and clearing the 2018 root crops to 28 February 2019. RENTAL PAYMENTS: The rent will be payable 6 monthly in arrears. RENT REVIEW: None. REPAIRS AND MAINTENANCE: The Tenant will be responsible for maintaining ditches and all hedges in no worse condition than at the commencement of the tenancy and with a full cut at least once. TENANT RIGHT: There will be no tenant right payable at the commencement of the tenancy save in respect of any work and costs in establishing 2019 crops, if any.
